Title IX and Discrimination

Title IX is a federal law that prohibits discrimination based on sex in any federally funded education program or activity. It applies to all aspects of education, including sports, academics and extracurricular activities. It protects students and employees from sexual harassment, assault, and discrimination based on gender identity, sexual orientation, or pregnancy.

Blue Mountain Community College strives to provide a safe environment in which students can pursue their education free of the detrimental effects of sexual assault, misconduct and discrimination. This mean that no one should be denied participation in or the benefits of any BMCC program or activity on the basis of sex, gender, sexual orientation, gender identity or gender expression. In accordance with Title IX, Oregon laws, and college policy, BMCC prohibits gender-based discrimination and harassment including:

  • Sexual harassment
  • Sexual assault
  • Stalking
  • Intimate partner violence
  • Dating violence
  • Domestic violence
 
BMCC is committed to providing support and assistance to all members of our campus community who are impacted by gender-based discrimination, harassment, and violence, including sexual assault, relationship or dating violence, and stalking. BMCC is committed to developing best practices to respond to and prevent sexual assault.

Reporting a Title IX or Discrimination Related Complaint

What is Sexual Misconduct.

What is Consent.

  • Right to learn and work in a safe environment. BMCC follows a zero tolerance policy for all forms of sexual misconduct and gender-based discrimination
  • Right to pursue a campus-based disciplinary process (if applicable).
  • Right to a prompt and fair investigation. BMCC is required to investigate all reports of sexual misconduct.
  • Right to pursue civil and criminal options through civil court and law enforcement.
  • Right to file a complaint without fear of retaliation. Anyone who reports sexual misconduct is protected from retaliation under the law.
  • Right to access support and health services. BMCC offers confidential counseling services and can connect you with on-campus and off-campus resources to help you heal.

Sexual misconduct offenses include, but are not limited to:

  • Sexual Harassment
  • Sexual Assault
  • Stalking
  • Quid Pro Quo Harassment
  • Non-consensual sexual contact (or attempts to commit same)
  • Non-consensual sexual intercourse (or attempts to commit same)
  • Domestic violence/dating violence/intimate partner violence
  • Sexual exploitation

 

The voluntary, informed, uncoerced agreement through words and actions freely given, which a reasonable person would interpret as a willingness to participate in mutually agreed-upon sexual acts. Consent is not affirmative, conscious, and voluntary if it is achieved by force, coercion, or if the individual is incapacitated and incapable of giving consent.

  • Consent to one act does not constitute consent to another act.
  • Consent on a prior occasion does not constitute consent on a subsequent occasion.
  • The existence of a prior or current relationship does not, in itself, constitute consent.
  • Consent can be withdrawn or modified at any time.
  • Consent is not implicit in a person’s manner of dress.
  • Accepting a meal, a gift, or an invitation for a date does not imply or constitute consent.
  • Silence, passivity, or lack of resistance does not constitute consent.

Pregnancy and Pregnancy-Related Conditions Information

Title IX also provides support for students who are pregnant or have pregnancy-related conditions related to childbirth, false pregnancy, termination of pregnancy, lactation or recovery from these conditions.

Class, Program and Other Accommodations

BMCC instructors will provide reasonable accommodations based on your individual needs. Examples include providing breaks for lactation or attend to health needs, excusing intermittent absence to attend medical appointments, access to online homework, extension on assignments, and rescheduling of tests, just to name a few. If you need an accommodation due to being pregnant or experiencing pregnancy-related conditions, please first contact your instructor to review options.
